The Police (1998 Act) (Commencement No. 3) Order (Northern Ireland) 1999

Made: 30th March 1999

The Secretary of State, in pursuance of sections 72(1) and (2) and 75 of the Police (Northern Ireland) Act 1998[^f00001], hereby makes the following Order:

Citation

This Order may be cited as the Police (1998 Act) (Commencement No. 3) Order (Northern Ireland) 1999.

Interpretation

In this Order, “the Act” means the Police (Northern Ireland) Act 1998.

Appointed day

3

Subject to Article 4, the following provisions of the Act shall come into operation on 1st April 1999—

• Part I insofar as not already commenced, except section 2(4)(a),

• Part III insofar as not already commenced, except sections 25(4) and 26(4),

• Part V insofar as not already commenced, except section 40(3) and (4),

• Sections 70 to 73,

• Section 74(1) and Schedule 4 (Amendments) insofar as not already commenced, except paragraphs 4, 8, 9, 20(3) to (5), 21 and 22(8),

• Section 74(2) and Part I of Schedule 5 (Transitional provisions and savings) insofar as not already commenced,

• Section 74(3) and Schedule 6 (Repeals) insofar as not already commenced, except those repeals which relate to the Superannuation Act (Northern Ireland) 1972; the Superannuation (Northern Ireland) Order 1972; the House of Commons Disqualification Act 1975; the Northern Ireland Assembly Disqualification Act 1975; the Police (Northern Ireland) Order 1987 and, in the Police (Amendment) (Northern Ireland) Order 1995, the definition of “the 1987 Order” in Article 2(2), and Part IV,

• Section 74(4),

• Section 76(3),

• Schedule 1.

Transitional provisions and savings

Any action or proceedings taken or commenced before the coming into force of this Order shall be valid notwithstanding the repeals in Schedule 6 listed in Article 3.

Explanatory note

This Order brings into force those sections of the Police (Northern Ireland) Act 1998 listed in Article 3 of this Order, together with relevant amendments, repeals, transitional provisions and savings, as from 1st April 1999.
