The Department for Regional Development[^f00001], in exercise of the powers conferred by section 14 of the Chronically Sick and Disabled Persons (Northern Ireland) Act 1978[^f00002] and now exercisable by it[^f00003] and of every other power enabling it in that behalf, hereby makes the following Regulations:

Citation and commencement

These Regulations may be cited as the Disabled Persons (Badges for Motor Vehicles) (Amendment No. 2) Regulations (Northern Ireland) 2000 and shall come into operation on 11th December 2000.

Amendment

The Disabled Persons (Badges for Motor Vehicles) Regulations (Northern Ireland) 1993[^f00004] shall be amended as follows—

  • “medical practitioner” means a registered person within the meaning of the Medical Act 1983[^f00005];

Form of Badge for an Individual issued on or after 1st July 1993

Diagram 2 — Form of Badge for Support Organisation issued on or after 1st July 1993

Diagram 3 — Form of badge for an individual issued on or after 1st April 2000

Diagram 4 — Form of badge for a support organisation issued on or after 1st April 2000

Explanatory note

(This note is not part of the Regulations.)

These regulations further amend the Disabled Persons (Badges for Motor Vehicles) Regulations (Northern Ireland) 1993.

The principal amendments are—

1 To provide a definition of “medical practitioner” (regulation 2(1)).

2 To provide that the return of a badge will occur only where there has been a misuse of a disabled person’s badge on at least 3 occasions which has led to a relevant conviction (regulation 2(2)).

3 The diagram numbers in Part I of the Schedule are renumbered and a revised specification inserted in Part II of the Schedule for badges issued on or after 1st April 2000 (regulation 2(3)).
