Royal Ulster Constabulary GC Foundation Regulations 2002

Made: 26th July 2002

Coming into operation: 16th September 2002

The Secretary of State, in pursuance of Section 70 of the Police (Northern Ireland) Act 2000[^f00001] makes the following regulations: –

Citation and commencement

These regulations may be cited as the Royal Ulster Constabulary GC Foundation Regulations 2002 and shall come into operation on 16th September 2002.

Interpretation

In these regulations –

• “the police service” and “police officer” have the same meaning as in Section 77 of the Police (Northern Ireland) Act 2000;

• “the Board” means the Board of Trustees of the Royal Ulster Constabulary GC Foundation.

Establishment of Royal Ulster Constabulary GC Foundation

There shall be established a foundation, to be known as “The Royal Ulster Constabulary GC Foundation” (in these regulations referred to as “the Foundation”) under the control of the Secretary of State for the purpose of marking the sacrifices and honouring the achievements of the Royal Ulster Constabulary.

Status and Constitution of the Foundation

• (1) The Foundation shall not be regarded as the servant or agent of the Crown or as enjoying any status, privilege or immunity of the Crown; and the Foundation’s property shall not be regarded as property of or property held on behalf of the Crown.

• (2) The Foundation shall comprise a Chairman and a Board of 5 Trustees to be appointed by the Secretary of State. Two of the Trustees may be nominated by the Chief Constable of the Police Service of Northern Ireland and the Chairman of the Northern Ireland Policing Board subject to the approval of the Secretary of State.

• (3) The Foundation shall also consult with a Stakeholders Group comprising representatives from the Police Federation for Northern Ireland, the Royal Ulster Constabulary Widows Association, the Royal Ulster Constabulary Disabled Police Officers Association or any other organisation or person within the Royal Ulster Constabulary family as the Board may deem appropriate.

• (4) It shall be a matter for the Board to decide on the manner of the representation of stakeholders to the Foundation.

Terms of office

• (1) Subject to the following provisions of this paragraph, a person shall hold and vacate office as a member or as chairman of the Foundation in accordance with the terms of his appointment.

• (2) The chairman and other members of the Board shall be appointed for a term of 5 years, and a person appointed to fill a casual vacancy shall hold office for the remainder of the term of the person in whose place he is appointed.

• (3) A person may at any time resign as a member or as chairman of the Foundation by notice in writing to the Secretary of State.

• (4) The Secretary of State may remove a person from office as a member or as chairman of the Foundation if satisfied that –

• (a) he has been convicted of a criminal offence;

• (b) he has become bankrupt or is the subject of a bankruptcy restrictions order or has had a debt relief order made in respect of him or is the subject of a debt relief restrictions order or made a composition or arrangement with his creditors;

• (c) he has failed to comply with the terms of his appointment; or

• (d) he is otherwise unable or unfit to discharge his functions.

• (5) A member of the Board whose term of office expires or who has resigned shall be eligible for re-appointment.

Allowances

The Foundation may pay to the Board such allowances as the Foundation, with the approval of the Secretary of State, may determine.

Functions

The Board of Trustees shall, in consultation with stakeholders, as appropriate, decide on the disbursement of funds and the funding of projects commensurate with its aim of marking the sacrifice and honouring the achievements of the Royal Ulster Constabulary and support the professional development of police officers and innovations in policing.

Procedures

• (1) The Foundation may regulate its own procedures.

• (2) The Board shall, not later than 3 months after the end of each financial year, submit to the Secretary of State a report on the work of the Foundation during that year.

Payments to the Foundation

• (1) The Secretary of State shall make payments to, or for the purposes of, the Foundation.

• (2) A grant under Regulation 9(1) –

• (a) shall be of such amount;

• (b) shall be paid at such time, or in instalments of such amounts and at such times; and

• (c) shall be made on such conditions,

as the Secretary of State may determine

• (3) A time determined under regulation 9(2)(b) may fall within or after the financial year concerned.

• (4) The Board may not borrow or raise money under this section for any purposes other than in connection with the functions of the Foundation.

• (5) All gifts received by way of donations to the Foundation must be recorded in the appropriate accounts.

Payments made by the Foundation

The Foundation may make payments from the accounts for the following purposes: –

• (a) for providing assistance, financial or otherwise, to serving police officers to support their professional development;

• (b) to assist in the development of innovations in policing;

• (c) for any other purpose which the Board considers to be in keeping with the aims and functions of the Foundation.

Accounts relating to the Foundation

The Foundation shall –

• (a) keep proper accounts and proper records in relation to the accounts;

• (b) prepare a statement of accounts in respect of each financial year which shall contain such information and shall be in such form as the Secretary of State may direct; and

• (c) send copies of the statement of accounts to the Comptroller and Auditor General within such period after the end of the financial year to which the statement relates as the Secretary of State may direct.

Support

• (a) Appropriate accommodation and support staff shall be provided for the Foundation from within the resources of the Police Service of Northern Ireland. The Foundation shall reimburse the cost of support staff, so provided, to the Police Service of Northern Ireland.

• (b) The Foundation may engage other support as is necessary or expedient for the proper functioning of the Foundation.

These Regulations provide for the establishment, maintenance and operation of a Royal Ulster Constabulary GC Foundation in accordance with Section 70 of the Police Act (Northern Ireland) 2000 for the purpose of marking the sacrifices and honouring the achievements of the Royal Ulster Constabulary.

The Comptroller and Auditor General shall—

• (a) examine, certify and report on a statement received under Regulation 11; and

• (b) send a copy of the statement with the report to the Secretary of State who shall lay them before Parliament.

Support
