Coming into operation: 1st April 2003
The Department of Finance and Personnel[^f00001], in exercise of the powers conferred on it by Article 39(2) and (3) of, and paragraph 4 of Part III of Schedule 12 to, the Rates (Northern Ireland) Order 1977[^f00002] and of every other power enabling it in that behalf, and after consultation with the Northern Ireland Local Government Association (being an association which appears to the Department to be representative of district councils), hereby makes the following Order:
Citation and commencement

This Order may be cited as the Valuation for Rating (Plant and Machinery) Order (Northern Ireland) 2003 and shall come into operation on 1st April 2003.
Classes of plant and machinery

For paragraph 3 of Part III of Schedule 12 to the Rates (Northern Ireland) Order 1977[^f00003] there shall be substituted the paragraph set out in the Schedule.
Revocation

The Valuation for Rating (Plant and Machinery) Order (Northern Ireland) 1997[^f00004] is hereby revoked.

Explanatory note
(This note is not part of the Order.)
This Order substitutes a new paragraph 3 in Part III of Schedule 12 to the Rates (Northern Ireland) Order 1977. It amends the classes of plant and machinery which can be valued for rating purposes partly to reflect the recommendations contained in the Report of the Expert Advisory Committee chaired by Mr Derek Wood CBE QC (Cm 4283). The Committee reviewed the rating of plant and machinery with a view to updating and harmonising it throughout the United Kingdom.
The Order also excludes certain plant and machinery of a combined heat and power station which is fully or partly exempt from climate change levy and which produces (at least in part) electrical power from valuation for rating purposes.
