(This note is not part of the Regulations.)

Regulation 1 provides for citation, commencement and interpretation.

Regulation 2 modifies the Superannuation (Miscellaneous Provisions) Act (Northern Ireland) 1969 (“the 1969 Act”) consequential upon the provisions of section 156 of the Pension Schemes (Northern Ireland) Act 1993 (“section 156”). The modified provisions clarify that office holders mentioned in section 2(1) of the 1969 Act may elect not to acquire pension rights under the 1969 Act, whether or not they join any other pension scheme and without the need to notify the Department for Employment and Learning of the identity of any pension scheme which they join.

Similarly, regulation 3 modifies the Lands Tribunal and Compensation Act (Northern Ireland) 1964 (“the 1964 Act”) consequential upon the provisions of section 156. The modified provisions clarify that the President and other members of the Lands Tribunal may elect not to acquire pension rights under the 1964 Act, whether or not they join any other pension scheme and without the need to notify the Lord Chancellor of the identity of any pension scheme which they join.
