Coming into operation: 31st March 2004

The Department of the Environment, in exercise of the powers conferred on it by Article 6(7) of the Litter (Northern Ireland) Order 1994[^f00001] and of all other powers enabling it in that behalf, hereby makes the following Order:

Citation and commencement

This Order may be cited as the Litter (Fixed Penalty) Order (Northern Ireland) 2004, and shall come into operation on 31st March 2004.

Amount of fixed penalty

For the amount of £25 specified as the amount of the fixed penalty in Article 6(6) of the Litter (Northern Ireland) Order 1994 there shall be substituted the amount of £50.

Revocation

The Litter (Fixed Penalty) Order (Northern Ireland) 1998[^f00002] is hereby revoked.

Explanatory note

(This note is not part of the Order.)

Article 6 of the Litter (Northern Ireland) Order 1994 makes provision for the payment of a fixed penalty to discharge any liability to conviction for the offence of leaving litter under Article 3 or permitting dogs to foul under Article 4 of that Order.

This Order increases the amount of the fixed penalty from £25 to £50.

This Order revokes the Litter (Fixed Penalty) Order (Northern Ireland) 1998, which had increased the fixed penalty from £10 to £25.
