The List of Wastes (Amendment) Regulations (Northern Ireland) 2005

Made: 21st October 2005

Coming into operation: 14th November 2005

The Department of the Environment, being a Department designated[^f00001] for the purposes of section 2(2) of the European Communities Act 1972[^f00002] in relation to measures relating to the prevention, reduction and elimination of pollution caused by waste and of all other powers enabling it in that behalf, hereby makes the following Regulations:

Citation and commencement

• (1) These Regulations may be cited as the List of Wastes (Amendment) Regulations (Northern Ireland) 2005, and shall come into operation on 14 November 2005.

• (2) The Interpretation Act (Northern Ireland) 1954[^f00003] shall apply to these Regulations as it applies to an Act of the Northern Ireland Assembly.

Amendment of the List of Wastes Regulations (Northern Ireland) 2005

• (1) The List of Wastes Regulations (Northern Ireland) 2005[^f00004] shall be amended in accordance with paragraphs (2) and (3).

• (2) In regulation 2 (interpretations) in sub-paragraph (b) for “Council Regulation (EC) No.807/2003” there shall be substituted “Commission Directive 2004/73/EC[^f00005]”.

• (3) In regulation 4(b) (properties and characteristics of dangerous substances classified as hazardous waste) for “R40 at a concentration = 1%.” there shall be substituted “R68 at a concentration = 1%”.

These Regulations correct minor errors in the List of Wastes Regulations (Northern Ireland) 2005 (S.R. 2005 No.301).
