The Social Security (Lebanon) (Amendment) Regulations (Northern Ireland) 2006

Made: 27th July 2006

Coming into operation: 28th July 2006

Proposals in respect of these Regulations were not referred to the Social Security Advisory Committee since it appeared to the Department for Social Development that by reason of the urgency of the matter it was inexpedient to do so[^f00006].

Citation, commencement, effect and interpretation

• (1) These Regulations shall be cited as the Social Security (Lebanon) (Amendment) Regulations (Northern Ireland) 2006 and shall come into operation on 28th July 2006.

• (2) These Regulations shall cease to have effect on 30th January 2007 and the following Regulations shall have effect on and after that date as if the amendments made by these Regulations had not been made—

• (a) the Income Support (General) Regulations (Northern Ireland) 1987[^f00007];

• (b) . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . .

• (c) the Jobseeker’s Allowance Regulations (Northern Ireland) 1996[^f00009];

• (d) the State Pension Credit Regulations (Northern Ireland) 2003[^f00010].

• (3) The Interpretation Act (Northern Ireland) 1954[^f00011] shall apply to these Regulations as it applies to an Act of the Assembly.

Amendment of the Income Support (General) Regulations

• (1) Regulation 21AA[^f00012] of the Income Support (General) Regulations (Northern Ireland) 1987 (special cases: supplemental—persons from abroad) is amended in accordance with paragraphs (2) and (3).

• (2) At the end of paragraph (4)(i) omit “or”.

• (3) At the end of paragraph (4)(j) add “; or” and the following sub-paragraph—

(k) a person in Northern Ireland who left Lebanon on or after 12th July 2006 because of the armed conflict there.

• (1) Regulation 85A[^f00015] of the Jobseeker’s Allowance Regulations (Northern Ireland) 1996 (special cases: supplemental—persons from abroad) is amended in accordance with paragraphs (2) and (3).

• (2) At the end of paragraph (4)(i) omit “or”.

• (3) At the end of paragraph (4)(j) add “; or” and the following sub-paragraph—

(k) a person in Northern Ireland who left Lebanon on or after 12th July 2006 because of the armed conflict there.

Amendment of the State Pension Credit Regulations

• (1) Regulation 2[^f00016] of the State Pension Credit Regulations (Northern Ireland) 2003 (persons not in Northern Ireland) is amended in accordance with paragraphs (2) and (3).

• (2) At the end of paragraph (4)(i) omit “or”.

• (3) At the end of paragraph (4)(j) add “; or” and the following sub-paragraph—

(k) a person in Northern Ireland who left Lebanon on or after 12th July 2006 because of the armed conflict there.

Explanatory note

(This note is not part of the Regulations)

These Regulations amend the Income Support (General) Regulations (Northern Ireland) 1987, the Housing Benefit (General) Regulations (Northern Ireland) 1987, the Jobseeker’s Allowance Regulations (Northern Ireland) 1996 and the State Pension Credit Regulations (Northern Ireland) 2003 (“the income-related benefits Regulations”).

The income-related benefits Regulations provide that a person is ineligible for benefit where he is a “person from abroad”, that is to say where he is not habitually resident in the United Kingdom, the Channel Islands, the Isle of Man or the Republic of Ireland, subject to a list of exceptions. The amendments made by these Regulations insert a new category into the list of persons who are excepted from having to satisfy the habitual residence test. This excepts persons in Northern Ireland who left Lebanon on or after 12th July 2006 because of the armed conflict there.

These Regulations cease to have effect on 30th January 2007. From that date the additional category will be omitted.
