The Department for Social Development makes the following Regulations in exercise of the powers conferred by Articles 280(1)(b) and 287(1) and (3) of the Pensions (Northern Ireland) Order 2005[^f00001].

Explanatory note

(This note is not part of the Regulations)

These Regulations modify Articles 236 and 238 of the Pensions (Northern Ireland) Order 2005 (“the Order”) in their application to occupational pension schemes in relation to which there is more than one employer. Those Articles already enable regulations to be made which apply to any person who is the trustee or manager of an occupational pension scheme. The modifications made by these Regulations enable regulations made under those Articles to extend to any other person who has power to make decisions in relation to a multi-employer scheme.

As these Regulations make only provision corresponding to provision contained in Regulations made by the Secretary of State for Work and Pensions in relation to Great Britain the requirement to consult under Article 289(1) of the Order does not apply by virtue of paragraph (2)(e) of that Article.
