Coming into operation in accordance with regulation 1(1)

The Department for Social Development makes the following Regulations in exercise of the powers conferred by sections 158C and 165(1) and (4) to (6) of the Social Security Administration (Northern Ireland) Act 1992[^f00001] and now vested in it[^f00002].

Amendment of the Social Security (Crediting and Treatment of Contributions, and National Insurance Numbers) Regulations

In regulation 9 of the Social Security (Crediting and Treatment of Contributions, and National Insurance Numbers) Regulations (Northern Ireland) 2001[^f00004] (application for allocation of national insurance number)—

(1A) An application under paragraph (1) shall be accompanied by a document of a description specified for the time being in Part 1 or Part 2, except paragraph 1(a) of Part 2, of the Schedule to the Immigration (Restrictions on Employment) Order 2004[^f00005].

; and

(4) Where a person— (a) qualifies for a loan made in accordance with regulations made under Article 3 of the Education (Student Support) (Northern Ireland) Order 1998[^f00006] (new arrangements for giving financial support to students) in connection with an academic year beginning on or after 1st September 2007; and (b) has been required as a condition of entitlement to payment of the loan to provide his national insurance number, he shall, unless he has already been allocated a national insurance number, apply to the Department or the Commissioners for Her Majesty’s Revenue and Customs for one to be allocated to him, and the Department or, as the case may be, the Commissioners may direct how the application is to be made.

Explanatory note

(This note is not part of the Regulations)

EXPLANATORY NOTE

These Regulations amend the Social Security (Crediting and Treatment of Contributions, and National Insurance Numbers) Regulations (Northern Ireland) 2001.

Regulation 2(a) provides that a person who is required to apply for a national insurance number because he is an employed earner or self-employed earner must provide a document described in Part 1or 2 of the Schedule to the Immigration (Restriction on Employment) Order 2004.

Regulation 2(b) requires a person, who does not already have a national insurance number, to apply for a national insurance number if he is required to provide one when he qualifies for a student loan under the Education (Student Support) (Northern Ireland) Order 1998.

These Regulations make in relation to Northern Ireland only provision corresponding to provision contained in Regulations made by the Secretary of State for Work and Pensions in relation to Great Britain and accordingly, by virtue of section 149(3) of, and paragraph 10 of Schedule 5 to, the Social Security Administration (Northern Ireland) Act 1992, are not subject to the requirement of section 149(2) of that Act for prior reference to the Social Security Advisory Committee.
