To be laid before Parliament under paragraph 7(3) of the Schedule to the Northern Ireland Act 2000

Coming into operation: 22nd January 2007

In accordance with section 3(6) of that Act, the Department has consulted persons appearing to it to represent councils and such other persons as appeared to the Department to be representative of interests affected by the proposals.

Power of district councils to establish or participate in companies

In exercising specified functions, a council may establish or participate in companies in order to carry out its duty under section 1(1) of the Local Government (Best Value) Act (Northern Ireland) 2002.

Explanatory note

(This note is not part of the Order)

EXPLANATORY NOTE

Section 1(1) of the Local Government (Best Value) Act (Northern Ireland) 2002 requires a district council to make arrangements for continuous improvement in the way in which its functions are exercised, having regard to a combination of economy, efficiency and effectiveness. This Order provides that, in exercising a function specified in the Schedule, a council may establish or participate in companies in order to carry out its duty under section 1(1) of that Act.
