The Department of the Environment makes the following Regulations in exercise of the powers conferred by sections 7(1) and (2) and 25(3) of the Food and Environment Protection Act 1985[^f00001].

Amendment to Deposits in the Sea (Exemptions) Order (Northern Ireland) 1995

(c) that operation does not involve the recovery or disposal of hazardous waste as defined by regulations 2(1) and 6 of the Hazardous Waste Regulations (Northern Ireland) 2005[^f00004].

Explanatory note

(This note is not part of the Regulations)

EXPLANATORY NOTE

These Regulations amend the Deposits in the Sea Exemptions Order (Northern Ireland) 1995 by inserting a further limitation on the application of the exemption viz the exemption shall only apply where the operation does not involve the recovery of disposal of hazardous waste as defined by regulations 2(1) and 6 of the Hazardous Waste Regulations (Northern Ireland 2005).
