In accordance with Article 62 (3) of that Order it has consulted with such organisations as appeared to the Department to be representative of medical practitioners practising as ophthalmic medical practitioners, and ophthalmic opticians.

Amendments to the principal Regulations

  • “income–related employment and support allowance” means an employment and support allowance, entitlement to which is based on section 1(2)(b) of the Welfare Reform Act (Northern Ireland) 2007 (income related employment and support allowance) [^f00004].

(n) he is in receipt of income–related employment and support allowance; or (o) he is a member of the same family as a person in receipt of income–related employment and support allowance.

(e) and in sub–paragraph (p) “family” has the meaning given to it by regulation 2 of the Employment and Support Allowance Regulations (Northern Ireland) 2008 [^f00005].

Explanatory note

(This note is not part of the Regulations)

EXPLANATORY NOTE

These Regulations further amend the Health and Personal Social Services (Optical Charges and Payments) Regulations (Northern Ireland) 1997 (“the principal Regulations”) which provide for payments to be made, by means of a voucher system, in respect of costs incurred by certain categories of persons in connection with the supply, replacement and repair of optical appliances.

Regulation 2 inserts a new definition into the principal Regulations and amends regulation 8 of those Regulations to provide that a person who is receiving income–related employment and support allowance (or a member of that person’s family) will be entitled to a voucher in respect of an optical appliance.
