Plant Protection Products (Amendment No 2) Regulations (Northern Ireland) 2008

The Department of Agriculture and Rural Development makes the following Regulations in exercise of the powers conferred by that section.
Citation, commencement and interpretation

- (1) These Regulations may be cited as the Plant Protection Products (Amendment No 2) Regulations (Northern Ireland) 2008 and shall come into operation on 12th January 2009.
- (2) The Interpretation Act (Northern Ireland) 1954[^f00005] shall apply to these Regulations as it applies to an Act of the Northern Ireland Assembly.
Amendment of the Plant Protection Products Regulations (Northern Ireland) 2005

- (1) The Plant Protection Products Regulations (Northern Ireland) 2005[^f00006] shall be amended in accordance with paragraphs (2) and (3).
- (2) In regulation 2(1) (interpretation), for the definition of “the Directive” substitute—
- “the Directive” means Council Directive 91/414/EEC concerning the placing of plant protection products on the market, as amended from time to time;
- (3) Schedule 1 (instruments amending Council Directive 91/414/EEC) is revoked.

The Plant Protection Products (Amendment) Regulations (Northern Ireland) 2008[^f00007] are revoked.

Explanatory note

EXPLANATORY NOTE
These Regulations amend the Plant Protection Products Regulations (Northern Ireland) 2005 (S.R. 2005 No. 526) (“the principal Regulations”) which implement in Northern Ireland Council Directive 91/414/EEC (O.J. No. L230, 19.8.91, p1) to be read with the Corrigenda published in O.J. No. L170, 25.6.92, p. 40) concerning the placing of plant protection products on the market (“the Directive”), as amended.
A new definition of the Directive is substituted to the effect that references to the Directive are references to it as amended from time to time (regulation 2(2)). Schedule 1 to the principal Regulations, which sets out the instruments that amend the Directive, is revoked (regulation 2(3)). Regulation 3 revokes the Plant Protection Products (Amendment) Regulations (Northern Ireland) 2008, the main purpose of which was to amend the definition of “the Directive” in the principal Regulations so as to implement specified Commission Directives.
