Coming into operation: 1st April 2015

The Department of the Environment makes the following Regulations in exercise of the powers conferred on it by sections 186(2) and 247(1) of the Planning Act (Northern Ireland) 2011[^f00001].

Citation, commencement and interpretation

These Regulations may be cited as the Planning (Claims for Compensation) Regulations (Northern Ireland) 2015 and shall come into operation on 1st April 2015.

In these Regulations a reference to a “section” is to a section of the Planning Act (Northern Ireland) 2011.

Claims for compensation

(1) A claim for compensation made to a council under section 186 (compensation for loss or damage caused by service of building preservation notice) shall be made in writing.

(2) Such a claim shall be made within 6 months from the date on which the building preservation notice ceases to have effect without the building having been included in a list compiled by the Department under section 80 (lists of buildings of special architectural or historic interest).

Revocation

ThePlanning (Claims for Compensation) Regulations (Northern Ireland) 2006[^f00002] are revoked.

Explanatory note

(This note is not part of the Regulations)

EXPLANATORY NOTE

The purpose of these Regulations is to prescribe the time within and the manner in which claims for compensation for loss or damage caused by the service of a building preservation notice shall be made to a council.

A regulatory impact assessment has been prepared in relation to these Regulations. A copy may be obtained from the Department of the Environment, Causeway Exchange, 1-7 Bedford Street, Town Parks, Belfast, BT2 7EG or accessed at www.doeni.gov.uk.
