Coming into operation in accordance with Rule 1

The Crown Court Rules Committee makes the following Rules in exercise of the powers conferred by sections 52(1) and 53A of the Judicature (Northern Ireland) Act 1978[^f00001].

Citation, commencement and interpretation

These Rules shall be cited as the Crown Court (Criminal Procedure and Investigations Act 1996) (Tainted Acquittals) (Amendment) Rules (Northern Ireland) 2016 and shall come into operation on the same day as section 1 of the Justice Act (Northern Ireland) 2015[^f00002].

In these Rules “the principal Rules” means the Crown Court (Criminal Procedure and Investigations Act 1996) (Tainted Acquittals) Rules (Northern Ireland) 1997[^f00003].

Amendment to the principal Rules

In Rule 4(1)(b) of the principal Rules, omit “for the petty sessions district for which that court sits”.

Explanatory note

EXPLANATORY NOTE

These rules amend the Crown Court (Criminal Procedure and Investigations Act 1996) (Tainted Acquittals) Rules (Northern Ireland) 1997 (S.R. 1997 No. 266), in consequence of the provisions in Part 1 of the Justice Act (Northern Ireland) 2015 which creates a single jurisdiction for county courts and magistrates’ courts whereby the jurisdiction and powers of those courts are exercisable throughout the whole of Northern Ireland.
