The Coronavirus Act 2020 (Commencement No.1) Order (Northern Ireland) 2020

Made: 31st March 2020

The Department of Health is satisfied that the condition specified in section 87(9) of that Act, is satisfied in relation to the provisions commenced by this Order.

Citation and interpretation

• (1) This Order may be cited as the Coronavirus Act 2020 (Commencement No.1) Order (Northern Ireland) 2020.

• (2) In this Order “the Act” means the Coronavirus Act 2020.

Appointed day

The day appointed for the coming into force of the following provisions of the Act is 2nd April 2020—

• (a) section 10(3) (temporary modification of mental health and mental capacity legislation);

• (b) section 10(4) (temporary modification of mental health and mental capacity legislation) insofar as it relates to the provisions of Schedule 11 (Mental Capacity: Northern Ireland) to the Act referred to in sub-paragraphs (d) to (g);

• (c) Schedule 10 (Mental Health: Northern Ireland);

• (d) Part 1 (Introductory provisions etc) of Schedule 11 (Mental Capacity: Northern Ireland);

• (e) paragraphs 3, 4, 5, 6, 7, 8, 9, 10 and 19 in Part 2 (Modifications of the Mental Capacity Act (Northern Ireland) 2016) of Schedule 11 (Mental Capacity: Northern Ireland);

• (f) paragraph 20 in Part 3 (Transitional provisions) of Schedule 11 (Mental Capacity: Northern Ireland) insofar as it refers to paragraphs 5 and 9 of that Schedule; and

• (g) Part 4 (Review of operation of certain provisions of this Schedule) of Schedule 11 (Mental Capacity: Northern Ireland)

EXPLANATORY NOTE

This Order commences section 10(3) of, and Schedule 10 to the Coronavirus Act 2020 on 2 April 2020 to introduce temporary modifications to the Mental Health (Northern Ireland) Order 1986.

This Order also commences section 10(4) of, and paragraphs referred to in Schedule 11 to the Coronavirus Act 2020 on 2 April 2020 to introduce temporary modifications to the Mental Capacity Act (Northern Ireland) 2016.
