The Tobacco Retailer (Fixed Penalty) (General) (Amendment) Regulations (Northern Ireland) 2021

Coming into operation: 1st February 2022
The Department of Health makes the following Regulations, in exercise of the powers conferred by sections 12(7) and 24(3) of the Tobacco Retailers Act (Northern Ireland) 2014[^f00001].
Citation and commencement

These Regulations may be cited as the Tobacco Retailer (Fixed Penalty) (General) (Amendment) Regulations (Northern Ireland) 2021 and shall come into operation on 1st February 2022.
Amendment of the Tobacco Retailer (Fixed Penalty) (General) Regulations (Northern Ireland) 2016

- (1) The Schedule to the Tobacco Retailer (Fixed Penalty) (General) Regulations (Northern Ireland) 2016[^f00002] is amended in accordance with paragraph (2) and (3).
- (2) In Parts 1 and 2 of the Schedule, after “Children and Young Persons (Protection from Tobacco) (Northern Ireland) Order 1991” insert “/the Health (Miscellaneous Provisions) Act (Northern Ireland) 2016”.
- (3) In Part 3 of the Schedule, for the words “Acceptable methods of payment are cash, cheque, postal order or money order.”, substitute “Acceptable methods of payment may include cash, cheque, postal order or money order.”.

EXPLANATORY NOTE
These Regulations amend the Tobacco Retailer (Fixed Penalty) (General) Regulations (Northern Ireland) 2016.
Regulation 2 amends the form of a fixed penalty notice which may be issued in respect of particular offences listed under section 12(1) of the Tobacco Retailers Act (Northern Ireland) 2014, to include an offence under section 1 of the Health (Miscellaneous Provisions) Act (Northern Ireland) 2016.
Regulation 3 amends the acceptable methods of payment to facilitate the use of alternative types of payment by District Councils in the future.
