The Bovine Viral Diarrhoea Eradication Scheme (Amendment) Order (Northern Ireland) 2024
Made: 20th December 2024
Coming into operation: 1st February 2025
In accordance with Article 8(1) of that Order, it has consulted with the bodies which appear to it to be substantially representative of the interests concerned.
Citation, commencement and interpretation

- (1) This Order may be cited as The Bovine Viral Diarrhoea Eradication Scheme (Amendment) Order (Northern Ireland) 2024 and comes into operation on 1st February 2025.
- (2) In this Order—
- “the 2016 Order” means the Bovine Viral Diarrhoea Eradication Scheme Order (Northern Ireland) 2016.
- (3) Expressions used in this Order and in the 2016 Order have the same meaning as in the 2016 Order.
Amendments to the Bovine Viral Diarrhoea Eradication Scheme Order (Northern Ireland) 2016

- (1) The Bovine Viral Diarrhoea Eradication Scheme Order (Northern Ireland) 2016[^f00004], is amended as follows.
- (2) In the Schedule—
- (a) after paragraph 3(4), insert—
(5) The keeper of any other bovine which does not possess a negative test result for BVDV from an approved laboratory shall— (a) ensure that a tissue sample is taken from that bovine; or (b) arrange for a blood sample to be taken from that bovine; and (c) ensure that the sample is dispatched to an approved laboratory within 7 days of taking the tissue sample for testing for BVDV. (6) The taking of a sample in accordance with sub-paragraph (5) shall be done— (a) where the keeper comes into possession or control of the bovine, within 20 days of the bovine coming into the possession or control of the keeper; or (b) in all other cases, within 20 days of the Department notifying the keeper that a bovine which does not possess a negative test result for BVDV from an approved laboratory is present in their herd.
- (b) in paragraph 4, omit the words “, born on or after the coming into operation of this Order”;
- (c) omit paragraph 14.
Transitional and Saving Provision

The revocation of paragraph 14 of the Schedule to the 2016 Order shall not affect the continued application of any restrictions imposed by or under that paragraph before the coming into operation of this Order until a tissue or blood sample has been taken in accordance with paragraphs 3, 4, 6 or 10 of the Schedule to the 2016 Order and a negative test result for that sample has been obtained from an approved laboratory.

Explanatory note
(This note is not part of the Order)
EXPLANATORY NOTE
This Order makes amendments to paragraphs 3 and 4 of the Schedule of the Bovine Diarrhoea Eradication Scheme Order (Northern Ireland) 2016 to facilitate testing of pre-2016 animals.
It also revokes paragraph 14 of the Schedule, which currently governs restrictions on movement of bovines infected or potentially infected with this disease. This provision is addressed in a separate Order.
