The Fire (Scotland) Act 2005 (Commencement No. 1) Order 2005

Made: 5th April 2005

The Scottish Ministers, in exercise of the powers conferred by sections 88 and 90 of the Fire (Scotland) Act 2005[^f00001], hereby make the following Order:

Citation and interpretation

This Order may be cited as the Fire (Scotland) Act 2005 (Commencement No. 1) Order 2005.

In this Order “the Act” means the Fire (Scotland) Act 2005.

Appointed day

6th April 2005 is the appointed day for the coming into force of–

• (a) sections 82 and 87 of the Act;

• (b) section 11 (conferral of functions in relation to other emergencies), section 16 (charging) and section 40 (framework document) of the Act, so far as they enable orders to be made; and

• (c) section 57 (risk assessments: power to make regulations), section 58 (Scottish Ministers' power to make regulations about fire safety) and section 78 (meaning of “relevant premises”) of the Act, so far as they enable regulations to be made.

Explanatory note

(This note is not part of the Order)

This Order brings into force on 6th April the following provisions of the Fire (Scotland) Act 2005–

• sections 82 and 87; and

• sections 11, 16, 40, 57, 58 and 78 so far as these sections enable orders or regulations to be made.
