Coming into force in accordance with article 1(2) and (3)

The Scottish Ministers, in exercise of the powers conferred by section 3(2) and (3) of the Public Appointments and Public Bodies etc. (Scotland) Act 2003[^f00001] and of all other powers enabling them in that behalf, hereby make the following Order, a draft of which has, in accordance with section 18(4) of that Act, been laid before and approved by resolution of the Scottish Parliament:

Treatment as specified authority

The Public Transport Users' Committee for Scotland shall be treated, for the purposes of or in connection with any appointment to that body, as if it were a specified authority within the meaning of section 2(1) of the Public Appointments and Public Bodies etc. (Scotland) Act 2003 (the Commissioner’s functions).

Amendment of list of specified authorities

In schedule 2 to the Public Appointments and Public Bodies etc. (Scotland) Act 2003 (authorities appointments to which are governed by a code of practice) under the heading “Advisory Bodies” insert at the appropriate place “Public Transport Users' Committee for Scotland”.

Explanatory note

(This note is not part of the Order)

This Order provides that the Public Transport Users' Committee for Scotland shall, for the purposes of appointments to this body, be treated as if it is a specified authority listed in schedule 2 to the Public Appointments and Public Bodies etc. (Scotland) Act 2003 (asp 4) and subsequently amends schedule 2 to that Act to add this body to the list of specified authorities.
