The Scottish Ministers, in exercise of the powers conferred by section 62(2) of the Local Government in Scotland Act 2003[^f00001], and of all other powers enabling them in that behalf, hereby make the following Order:

Explanatory note

(This note is not part of the Order)

Article 2 of this Order appoints days for the coming into force of section 47 of the Local Government in Scotland Act 2003 (“the Act”).

Section 47(1) imposes a duty upon local authorities to make grants to eligible persons to enable them to improve their private water supply, or to enable them to provide themselves with a private water supply.

Section 47(3) further provides that the Scottish Ministers may, by Regulations, make provision for the making of applications for such grants.

The Act received Royal Assent on 11th February 2003. Sections 42(1), 42(2), 50 and 62 came into force on Royal Assent. The first commencement order was made on 4th March 2003 (S.S.I. 2003/134 (C.7)), and the second commencement order was made on 29th January 2004 (S.S.I. 2004/28 (C.1)). The provisions of the Act remaining to be commenced for all purposes after the making of this Order are sections 8, 9, 11 and 40.
