The Lords of Council and Session, under and by virtue of the powers conferred upon them by section 48 of the Civil Jurisdiction and Judgments Act 1982[^f00001], section 5 of the Court of Session Act 1988[^f00002] and of all other powers enabling them in that behalf, do hereby enact and declare:

  • Council Regulation (EC) No. 44/2001 of 22nd December 2000 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters as amended from time to time to time and as applied by the Agreement of 19th October 2005 between the European Community and the Kingdom of Denmark on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters;[^f00004]
  • Council Regulation (EC) No. 44/2001 of 22nd December 2000 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters as amended from time to time to time and as applied by the Agreement of 19th October 2005 between the European Community and the Kingdom of Denmark on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters;

Explanatory note

(This note is not part of the Act of Sederunt)

This Act of Sederunt makes amendments to the Rules of the Court of Session 1994 (S.I. 1994/1443). The amendments take account of the extension of Council Regulation (EC) No. 44 of 2001 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters to Denmark by an Agreement between the European Community and the Kingdom of Denmark dated 19th October 2005 and coming into force on 1st July 2007.
