The Scottish Ministers make the following Order in exercise of the powers conferred by section 59(2) of the Planning etc. (Scotland) Act 2006[^f00001].

Explanatory note

(This note is not part of the Order)

To the extent they are not already in force, this Order brings sections 2, 53, 54(11)(a), (12), (14), (15) and (16)(b)(i) and (f) of the Planning etc. (Scotland) Act 2006 (“the Act”) into force on 28th February 2009 for all purposes.

Article 2 (2) limits the purposes for which section 54(17)(a)(i) is commenced on 28th February 2009. That provision, to the extent not already in force, is commenced for the purpose of inserting a new definition into section 277 of the Town and Country Planning (Scotland) Act [1997 (c. 8)](https://www.legislation.gov.uk/ukpga/1997/8).
