The Scottish Ministers make the following Order in exercise of the powers conferred by section 153(4) of the Environmental Protection Act 1990[^f00001] and all other powers enabling them to do so.

Variation of section 153(1) of the Environmental Protection Act 1990

In section 153(1) of the Environmental Protection Act 1990[^f00002] (financial assistance for environmental purposes), after paragraph (yy)[^f00003], insert–

(zz) the scheme known as the Community and Renewable Energy Scheme.

Explanatory note

(This note is not part of the Order)

This Order varies section 153(1) of the Environmental Protection Act 1990 so as to enable the Scottish Ministers to give financial assistance to, or for the purposes of, the scheme known as the Community and Renewable Energy Scheme with effect from 6th April 2009.
