The functions of the Secretary of State were transferred to the Scottish Ministers by section 53 of the Scotland Act 1998 (c.46), as read with section 5(3) of the said 1999 Act. Directive 2008/112/EC of the European Parliament and of the Council amending certain Directives in order to adapt them to Regulation (EC) No. 1272/2008 on classification, labelling and packaging of substances and mixtures (O.J. L 345, 23.12.2008, p. 68) was designated for the purposes of paragraph 20(2)(c) of Part1 of Schedule 1 to the 1999 Act by the Pollution Prevention and Control (Designation of Classification of Substances and Mixtures Directive) (Scotland) Order 2010 (S.S.I. 2010/235).
