EXPLANATORY NOTE
This Order modifies the Cairngorms National Park Designation, Transitional and Consequential Provisions (Scotland) Order 2003 (“the 2003 Order”).
Article 2 (2) of this Order modifies the 2003 Order by altering the reference in article 3 to refer to the new deposited map with the effect that the southern boundary of the Cairngorms National Park is extended into Perth and Kinross.
Article 2 (3) of this Order alters the constitution of the Cairngorms National Park Authority (“the Authority”) by modifying article 5 of the 2003 Order so that the number of members is reduced from 25 to 19. It also reduces the number of members nominated by Highland Council and Aberdeenshire Council and provides for Perth and Kinross Council to nominate one member.
Article 2 (4) of this Order deletes article 7(18) of the 2003 Order which provided that the Authority establish a planning committee.
Article 3 of this Order contains a consequential modification in relation to the definition of “local authority” contained in section 32 of the Land Reform (Scotland) Act 2003 with the effect that the Authority is the access authority in relation to land within the Cairngorms National Park.
