EXPLANATORY NOTE
This Order appoints 22nd July 2012 for the coming into force of paragraph 7(5) of schedule 5 to the Water Services etc. (Scotland) Act 2005 (“the 2005 Act”).
That provision repeals section40 of the Water Industry (Scotland) Act 2002 (asp3) (“the 2002 Act”), which empowered the Scottish Ministers to make regulations reducing the charges payable by certain persons under section37 of that Act. Provision for reduced charges is now made through the Ministers’ statement of policy regarding charges that is issued to Scottish Water and the Water Industry Commission for Scotland under section29D of the 2002 Act.
