Sections 2(1) and 3(1) were amended by the European Communities Act 1972 (c.68) (“the 1972 Act”), section4(1) and Schedule 4, paragraph 8 and further amended by S.I.2011/1043, Part 2, article 6(1)(e). Section 3(4) was substituted by section 42 of the Criminal Justice Act 1982 (c.48) and the Statute Law (Repeals) Act 1993 (c.50), section 1(1) and Schedule 1, Part XIV. There are other amendments which are not relevant to this Order. The functions of the Secretary of State, so far as they are exercisable within devolved competence, were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c.46).

Section 2(2) was amended by the Scotland Act 1998 (c.46) (“the 1998 Act”), Schedule 8, paragraph 15(3) (which was amended by section 27(4) of the Legislative and Regulatory Reform Act 2006 (c.51) (“the 2006 Act”)). Section 2(2) was also amended by section27(1)(a) of the 2006 Act and by the European Union (Amendment) Act 2008 (c.7) (“the 2008 Act”), section 3(3) and Schedule, Part1. The functions conferred on the Minister of the Crown under section 2(2), so far as exercisable within devolved competence, were transferred to the Scottish Ministers by virtue of section 53 of the 1998 Act. Section2(2) is relevant to the modifications made by article6. Paragraph1(d) of Schedule2 to the European Communities Act 1972 has been modified by section47 of the Criminal Proceedings etc. (Reform) (Scotland) Act 2007 (asp6) in order that the functions conferred under section2(2) can be exercised to create an offence punishable on summary conviction by a fine of up to the statutory maximum. Paragraph 1A of Schedule 2 was inserted by section 28 of the 2006 Act and was amended by the 2008 Act, section 3(3) and Schedule, Part 1.
