The Wildlife and Natural Environment (Scotland) Act 2011 (Commencement No. 2) Amendment (No. 2) Order 2012

The Scottish Ministers make the following Order in exercise of the powers conferred by section43(1) and (2)(a) of the Wildlife and Natural Environment (Scotland) Act 2011[^f00001].

Citation and commencement

This Order may be cited as the Wildlife and Natural Environment (Scotland) Act 2011 (Commencement No.2) Amendment (No.2) Order 2012 and comes into force on 22ndNovember 2012.

Amendment of Commencement No. 2 Order

• (1) Article2 (appointed days) of the Wildlife and Natural Environment (Scotland) Act 2011 (Commencement No.2) Order 2011[^f00002] is amended as follows.

• (2) After paragraph (3) insert—

(3A) 22nd November 2012 is the day appointed for the coming into force of— (a) section13(3) of the 2011 Act so far as it inserts section11A(4) and (9) into the 1981 Act; and (b) section13(5) of the 2011 Act.

• (3) In paragraph(4), for “1stJanuary 2013” substitute “1stApril 2013”.

Explanatory note

(This note is not part of the Order)

EXPLANATORY NOTE

This Order amends the Wildlife and Natural Environment (Scotland) Act 2011 (Commencement No.2) Order 2011 (“the Order”) with regard to the commencement of section 13 (snares) of the Wildlife and Natural Environment (Scotland) Act 2011 (“the 2011 Act”).

It inserts a new article2(3A) into the Order with the effect that section 13(3) (insofar as it inserts section11A(4) and (9) into the Wildlife and Countryside Act 1981) and section13(5) of the 2011 Act come into force on 22ndNovember 2012.

It also amends article2(4) of the Order so that the provisions of section13 of the 2011 Act not already in force will come into force on 1stApril 2013.
