Act of Sederunt (Summary Applications, Statutory Applications and Appeals etc. Rules Amendment) (Miscellaneous) 2013

The Lords of Council and Session, under and by virtue of the powers conferred by section32 of the Sheriff Courts (Scotland) Act 1971[^f00001], section446 of the Proceeds of Crime Act 2002[^f00002] and of all other powers enabling them in that behalf, having approved with such modifications as they think appropriate draft rules submitted to them by the Scottish Civil Justice Council in accordance with section 4 of the Scottish Civil Justice Council and Criminal Legal Assistance Act 2013[^f00003], do hereby enact and declare:
Citation, commencement and interpretation

- (1) This Act of Sederunt may be cited as the Act of Sederunt (Summary Applications, Statutory Applications and Appeals etc. Rules Amendment) (Miscellaneous) 2013.
- (2) It comes into force on 11th November 2013.
- (3) A certified copy of this Act of Sederunt is to be inserted in the Books of Sederunt.
- (4) In this Act of Sederunt the “Summary Application Rules” means the Act of Sederunt (Summary Applications, Statutory Applications and Appeals etc. Rules) 1999[^f00004].
Adults with Incapacity

- (1) The Summary Application Rules are amended in accordance with the following subparagraphs.
- (2) In rule3.16.1 (Interpretation)[^f00005], for the definition of “guardianship order” substitute—
- “guardianship order” means an order made under— section57(2)(c) or section58(1A) of the Criminal Procedure (Scotland) Act 1995; or section58(4) of the 2000 Act;
- (3) In rule3.16.4 (Service of application and renewal proceedings)[^f00006]—
- (a) in paragraph (1) at the end of head (ii) of subparagraph (i), insert “and”;
- (b) in paragraph (4)—
- (i) at the beginning of subparagraph(a), insert “immediately”;
- (ii) in subparagraph(b) before “complete”, insert “, and in any event before the date of the hearing specified in Form20,”.
- (4) In rule3.16.8 (Subsequent applications)[^f00007]—
- (a) after paragraph(1), insert—
(1ZA) Where a guardianship order has been made under section57(2)(c) or section58(1A) of the Criminal Procedure (Scotland) Act 1995, an application to renew it shall be made— (a) on the first such application, in Form23; (b) on any subsequent application, in the form of a minute lodged in the process.
- (b) in paragraph(1A) for “any such minute” substitute “any minute lodged under this rule”.
- (5) In Form21 (Form of notice to managers)[^f00008] after “You are requested”, insert “immediately on receipt”.
Civil Recovery: external investigations

After Part XLII (Regulation of Investigatory Powers Act 2000)[^f00009] of the Summary Application Rules, insert—
(3.43.1) This Part applies to applications to the sheriff under Part2 of the Proceeds of Crime Act 2002 (External Investigations) Order 2013[^f00010]. (3.43.2) (1) An application under the following provisions shall be made by summary application— (a) article40(1) (production orders); (b) article47(1) (search warrants); (c) article56(1) (customer information orders); (d) article63(1) (account monitoring orders). (2) An application under the following provisions shall be made by minute in the process of the original application— (a) article46(2) (discharge or variation of a production order or an order to grant entry); (b) article62(2) (discharge or variation of a customer information order); (c) article67(2) (discharge or variation of an account monitoring order). (3) An application under article42(2) (order to grant entry) shall be made— (a) in the application for the production order; or (b) where the application is made after a production order is made, by minute in the process of the application for the production order.
Saving provision

The amendments made to the Summary Application Rules by paragraph2 have no effect in respect of any application or proceedings raised but not yet determined by 11th November 2013.

Explanatory note
(This note is not part of the Act of Sederunt)
EXPLANATORY NOTE
This Act of Sederunt makes amendments to the Summary Application Rules in respect of proceedings under the Adults with Incapacity (Scotland) Act 2000 and under the Proceeds of Crime Act 2002 (External Investigations) Order 2013.
Paragraph2 amends Part XVI of the Summary Application Rules, which relates to proceedings under the Adults with Incapacity (Scotland) Act 2000.
Paragraph2(2) substitutes a new definition of “guardianship order” so that it refers expressly to guardianship orders granted under section57(2)(c) or section58(1A) of the Criminal Procedure (Scotland) Act 1995, as well as those under section58(4) of the Adults with Incapacity (Scotland) Act 2000.
Paragraph2(3)(a) makes a minor correction to rule3.16.4(1), which specifies the persons on whom service of an application or other proceedings must be effected.
Paragraph2(3)(b) amends rule3.16.4(4), which requires the managers of authorised establishments (within the meaning of section35(2) of the Adults with Incapacity (Scotland) Act 2000) to deliver Form20 (notice of hearing) to an adult who is in an authorised establishment. It clarifies the timescales within which that delivery is to take place. Paragraph2(5) makes a corresponding amendment to Form21.
Paragraph2(4) inserts a new paragraph(1ZA) into rule3.16.8 in order to provide for the situation where a guardianship order was first made by a criminal court under the Criminal Procedure (Scotland) Act 1995. In those circumstances, there is no civil process in which to lodge a minute seeking renewal of the order, and so the new provision provides for applications to be made in Form23 in the first instance and thereafter by minute in the process. It makes a consequential amendment to paragraph(1A).
Paragraph3 inserts a new Part XLIII of Chapter 3 which prescribes the form in which applications under the provisions of the Proceeds of Crime Act 2002 (External Investigations) Order 2013 are to be made.
The Act of Sederunt comes into force on 11th November 2013. Paragraph4 provides that the amendments in paragraph2 do not apply to applications or other proceedings raised but not determined by that date.
