The functions of the Secretary of State were, so far as exercisable within devolved competence, transferred to the Scottish Ministers by virtue of section 142(6) of the Sexual Offences Act 2003 and section 53 of the Scotland Act 1998 (c.46). Section 87(1)(a) was relevantly amended by S.S.I. 2013/119. Section 138(4) was inserted by section 102(6) of the Criminal Justice and Licensing (Scotland) Act 2010 (asp 13).
