Coming into force: 20th October 2014

The Scottish Ministers make these Regulations in exercise of the powers conferred by sections 88, 89, 90 and 96(2) of the Climate Change (Scotland) Act 2009 and all other powers enabling them to do so.

In accordance with section 96(4) of that Act , a draft of this instrument has been laid before and approved by resolution of the Scottish Parliament.

Before the draft was so laid, the Scottish Ministers laid a copy of the proposed Regulations before the Scottish Parliament under section 97(2) of that Act.

The Scottish Ministers have carried out the pre-laying procedure in accordance with that section.

In accordance with section 97(6) of that Act, the Scottish Ministers have had regard to any representations on the proposed regulations made to them, and to any report relating to the proposed regulations published by any committee of the Scottish Parliament for the time being appointed by virtue of standing orders.

PART 1 — Introduction

Citation and commencement

These Regulations may be cited as the Single Use Carrier Bags Charge (Scotland) Regulations 2014 and come into force on 20th October 2014.

Enforcement authority

A local authority is the enforcement authority for the area of the authority for the purpose of these Regulations.

Ascertainment of the net proceeds raised by the charge for a reporting year

and in relation to the reporting year beginning on 20th October 2014 includes such costs incurred by a supplier before these Regulations come into force.

the individual as well as the body corporate, Scottish partnership or unincorporated association commits an offence and is liable to be proceeded against and punished accordingly.

A single use carrier bag is used for a purpose described in this paragraph if it is—

where the bag is necessary for reasons of security, good order, discipline or safety
