21A
- (1) Sub-paragraph (2) applies where—
- (a) a transition member (P) is in winding down employment under regulation J2 of the 2005 Regulations immediately before P’s transition date; and
- (b) at the time of completing pensionable service under this scheme, P would still have been regarded as being in winding down employment had P remained as an active member of the existing scheme.
- (2) For the purpose of calculating benefits payable under the existing scheme, P’s final salary will be determined by reference to regulation E34(15) of the 2005 Regulations.

SCHEDULE 4 — Scheme valuation and employer cost cap
Scheme valuation report

The scheme manager must commission the scheme actuary to carry out a valuation of this scheme (“scheme valuation”) and any connected scheme, and to prepare a scheme valuation report, in accordance with, and by reference to the effective dates defined and set out in, HM Treasury directions under section 11 of the Act (referred to in this Schedule as “Treasury directions”).
Employer cost cap
2
The employer cost cap for this scheme is 12.4% of the pensionable earnings of members of this scheme.
Breach of employer cost cap margins
3
If the scheme actuary reports in a valuation report that the cost cap cost of the scheme, calculated following a valuation in accordance with Treasury directions, has gone beyond the margins specified in HM Treasury regulations under section 12 of the Act, paragraph 4 applies.
Scottish Teachers’ Pension Scheme Advisory Board report
4
Where this paragraph applies, the responsible authority must request the Scottish Teachers’ Pension Scheme Advisory Board constituted under Part 2 of these Regulations to report within six months of the request—
- (a) whether there is agreement between the employer representatives and the member representatives on a recommended procedure for aligning the cost cap cost of the scheme with the employer cost cap; and
- (b) if there is such agreement, the procedure which the board is in agreement to recommend.
Action by the responsible authority

On receipt of the Scottish Teachers’ Pension Scheme Advisory Board’s report, the responsible authority, in consultation with the scheme actuary and with such persons as the responsible authority considers appropriate, must—
- (a) review any recommendation put forward in that report; and
- (b) either—
- (i) if agreement has been reached, and the responsible authority accepts the proposed procedure, implement the procedure agreed between the members of the Scottish Teachers’ Pension Scheme Advisory Board; or
- (ii) if the responsible authority does not agree with any agreement reached, or if agreement has not been reached, make such change to the standard accrual rate as in the opinion of the scheme actuary is necessary to bring the cost cap cost of the scheme into line with the employer cost cap.
Timescale for action

Any changes to the scheme made as a result of paragraph 5 are to take effect within four years of the effective date as at which the cost cap of the scheme was evaluated in the scheme actuary’s valuation report.
Meaning of “accepted phased withdrawal school”
2A
- (1) An establishment is an accepted phased withdrawal school if the scheme manager accepts it for the purpose of this paragraph by giving its governing body or proprietor a written notice specifying the date on which it becomes an accepted phased withdrawal school.
- (2) An establishment may be so accepted only if—
- (a) it is an accepted school, and
- (b) its governing body or proprietor makes a written application to the scheme manager.
- (3) An establishment, if so accepted by the scheme manager, becomes an accepted phased withdrawal school from the date agreed between the scheme manager and its governing body or proprietor, which must be the first day of a month after the month in which the application under sub-paragraph (2)(b) is made.
- (4) An establishment so accepted by the scheme manager ceases to be an accepted phased withdrawal school on such a day as is specified in a notice in writing sent by the scheme manager to the governing body or proprietor of the school on or after any of the following events—
- (a) the receipt by the scheme manager of an application by the governing body or proprietor of the school seeking that it should cease to be an accepted phased withdrawal school,
- (b) the school ceasing to be registered,
- (c) any default by the governing body or proprietor in the payment of contributions, whether under these Regulations or under the Teachers’ Superannuation and Pension Scheme (Additional Voluntary Contributions) (Scotland) Regulations 2017,
- (d) failure by the governing body or proprietor to comply within one month with any requirement of the scheme manager to make any report or return, give any information or produce any document under regulation 209,
- (e) failure by the governing body or proprietor to comply with any other provision of these Regulations relating to the employment of teachers who are in eligible employment,
- (f) the closure of the school.
- (5) Where an establishment ceases to be an accepted phased withdrawal school—
- (a) it does not in consequence become an accepted school, but
- (b) sub-paragraph (a) does not prevent a separate application being made for the establishment to be an accepted school under paragraph 2.
- (6) In this schedule—
- “accepted phased withdrawal teacher” means—as from the date agreed under paragraph (3), a person who, immediately before that date, is in pensionable employment at the establishment under schedule 2 and is entitled to salary paid in full as indicated in regulation 22(1)(a),as from the date immediately after the end of a period of leave, which—falls within regulation 22(1)(b) or (c), andhas a continuous duration no longer than five years,a person who, immediately before the date agreed under paragraph (3), is in pensionable employment at the establishment but, because of that leave, is not so entitled,as from the date immediately after the end of a period of family leave or sick leave, which—falls within regulation 22(2), andhas a continuous duration no longer than five years,a person who, immediately before the date agreed under paragraph (3), is not in pensionable service at the establishment but only because of the application of regulation 22(2) to that person, oras from the date immediately after the ending of the period of effect of an opt-out under regulation 27, subject to an opt-out notice received by the scheme manager under that regulation before the date agreed under paragraph (3), a person who is not in pensionable employment at the establishment but only because of the application of regulation 27 to that person, andas from the date immediately after the ending of the period of effect of an opt-out under regulation 30, subject to an opt-out notice received by the scheme manager under that regulation before the date agreed under paragraph (3), a person who is not in pensionable employment at the establishment but only because of the application of regulation 30 to that person.

- (1) Subject to sub-paragraph (2), employment as an accepted phased withdrawal teacher in a school which is an accepted phased withdrawal school.
- (2) The service of an accepted phased withdrawal teacher in an accepted phased withdrawal school is not pensionable employment if the teacher is a proprietor of the school.
15A
Employment as a music instructor, educational psychologist, senior educational psychologist, depute principal educational psychologist, principal educational psychologist, education support officer, quality improvement officer or quality improvement manager in a public school or by an education authority.
15B
Employment as a researcher engaged in research in education at a college of further education, or institution providing higher education, as defined in the Further and Higher Education (Scotland) Act 1992, where the employee’s employment immediately before commencing that employment as a researcher was reckonable service under an enactment relating to pensions for teachers in Scotland, England, Wales or Northern Ireland.
15C
Employment for a temporary period not exceeding four years in a post connected to education, the control or supervision of teachers or lecturers, or services ancillary to education, where the employee’s employment immediately before commencing that employment was reckonable service under an enactment relating to pensions for teachers in Scotland.
15D
Employment by an education authority, college of further education or institution providing higher education, as defined in the Further and Higher Education (Scotland) Act 1992, in a post connected to the control or supervision of teachers or lecturers, where the employee’s employment immediately before commencing that employment was reckonable service under an enactment relating to pensions for teachers in Scotland, England, Wales or Northern Ireland.
