The Community Empowerment (Scotland) Act 2015 (Commencement No. 9) Order 2017

The Scottish Ministers make the following Order in exercise of the power conferred by section 145(2) of the Community Empowerment (Scotland) Act 2015[^f00001] and all other powers enabling them to do so.

Citation and commencement

This Order may be cited as the Community Empowerment (Scotland) Act 2015 (Commencement No. 9) Order 2017 and comes into force on 15th December 2017.

Appointed day

• (1) Subject to paragraph (2), the day appointed for the coming into force of the following provisions of the Community Empowerment (Scotland) Act 2015 is 15th December 2017:—

• (a) section 133(4), (5) and (6) (compensation for disturbance);

• (b) section 134(4), (5) and (6) (compensation for deterioration of allotment); and

• (c) section 135(3), (4) and (5) (compensation for loss of crops).

• (2) The provisions in paragraph (1) come into force on 15th December 2017 only for the purpose of making regulations.

Explanatory note

(This note is not part of the Order)

EXPLANATORY NOTE

This Order brings into force certain provisions of Part 9 (Allotments) of the Community Empowerment (Scotland) Act 2015 (“the Act”).

It commences on 15th December 2017 the provisions of the Act set out in article 2(1) which relate to Ministerial powers to make regulations. These provisions are commenced for the limited purpose of making regulations as set out in article 2(2).

The Bill for the Act received Royal Assent on 24th July 2015. Sections 141 to 143, 145 and 146 came into force the following day.
