The Scottish Ministers make the following Order in exercise of the powers conferred by sections 50(3) and 85(3) of the Agriculture (Scotland) Act 1948[^f00001] and all other powers enabling them to do so.
Citation and commencement

- (1) This Order may be cited as the Spring Traps Approval (Scotland) Amendment Order 2020.
- (2) This Order comes into force on 10 February 2021.
Amendment of the Spring Traps Approval (Scotland) Order 2011

- (1) The schedule of the Spring Traps Approval (Scotland) Order 2011[^f00002] is amended in accordance with paragraphs (2) to (5).
- (2) In entry 4 (DOC 150) and entry 5 (DOC 200 and DOC 250), in the conditions in Column (2) in each case, for “The tunnel must include an internal baffle arrangement” to the end of the sentence, substitute—
The tunnel must include an internal baffle arrangement that conforms to the type described in the Department of Conservation’s design specifications as set out in the Predator Trap Instructions UK and published on SASA’s website[^f00003] on 10th February 2021
- (3) In entry 9d (Goodnature A24 rat and stoat Trap), in the conditions in Column (2), after “weasels” insert “, edible dormice (Glis glis)”.
- (4) After entry 16 (Nooski mouse trap), insert the following entry—

- (5) After entry 22a (Tully Trap), insert the following entry—

Tully Trap fitted with baffles for grey squirrels manufactured by or under the authority of KM Pressings Ltd, 37B Copenhagen Road, Sutton Fields Industrial Estate, Hull, East Yorkshire, HU7 0XQ, UK. | The trap is to be used only for the purpose of killing or taking grey squirrels, stoats, weasels and rats. |

Tully Trap fitted with baffles for grey squirrels manufactured by or under the authority of KM Pressings Ltd, 37B Copenhagen Road, Sutton Fields Industrial Estate, Hull, East Yorkshire, HU7 0XQ, UK. | The trap must be fitted with baffles for grey squirrels supplied by the manufacturer or constructed to the manufacturer’s specifications as set out in the ‘Tully Trap Grey Squirrel Baffle Instructions’ produced by the manufacturer and published on SASA’s website[^f00004] on 10th February 2021. The trap must be positioned in relation to the baffle or baffles so that it conforms with those specifications. |

Explanatory note

EXPLANATORY NOTE
This Order amends the Spring Traps Approval (Scotland) Order 2011 (“the 2011 Order”). It comes into force on the 10 February 2021.
The 2011 Order specifies the types and makes of trap which are approved for use under section 50(1)(b) of the Agriculture Act 1948 (“the 1948 Act”). It is an offence to use a spring trap which is not approved for the purposes of that section and section 50(1)(c) of the 1948 Act creates offences relevant to unlawful use. This Order makes amendments to the categories of trap which are approved for use and amendments to the target species for traps approved for use.
No business and regulatory impact assessment has been prepared for this Order as no impact upon business, charities or voluntary bodies is anticipated.
