The Scottish Ministers make the following Order in exercise of the powers conferred by sections 61(2) and 63(2) of the Local Electoral Administration and Registration Services (Scotland) Act 2006[^f00001].

Citation, commencement and interpretation

Appointed day

The day appointed for the coming into force of section 17 (meaning of election expenses) and schedule 1 (insertion of schedule regarding election expenses) of the 2006 Act is 28 September 2021.

Transitional Provision

The provisions of the 2006 Act brought into force by this Order do not have effect in relation to an election for which the date of poll is on or before 4 May 2022.

Explanatory note

(This note is not part of the Order)

EXPLANATORY NOTE

This Order brings into force section 17 of the Local Electoral Administration and Registration Services (Scotland) Act 2006 (“the 2006 Act”), together with schedule 1 of that Act, on 28September2021.

By virtue of article 3 of this Order, section 17 and schedule 1 of the 2006 Act do not have effect in relation to a Scottish local government election held on or before 4 May 2022.

The Bill for the 2006 Act received Royal Assent on 1 August 2006. Sections 61 to 63 of the 2006 Act came into force on that day.
