The Scottish Ministers make the following Regulations in exercise of the powers conferred by section 63(2) of the Management of Offenders (Scotland) Act 2019[^f00001].

Citation and commencement

These Regulations may be cited as the Management of Offenders (Scotland) Act 2019 (Commencement No. 7) Regulations 2023 and come into force on 3 July 2023.

Appointed Day

3 July 2023 is the day appointed for the coming into force of section 58 (parole board recommendations: publication of test) of the Management of Offenders (Scotland) Act 2019.

Explanatory note

(This note is not part of the Regulations)

EXPLANATORY NOTE

These Regulations bring into force section 58 (parole board recommendations: publication of test) of the Management of Offenders (Scotland) Act 2019 (“the 2019 Act”) on 3 July 2023.

Section 58 inserts a new subsection (3B) into section 1 of the Prisoners and Criminal Proceedings (Scotland) Act 1993 (c. 9) (“the 1993 Act”), which requires the Parole Board for Scotland to publish, in such manner as it considers appropriate, the test that it will apply in making a recommendation to release a long-term prisoner under subsection (3) of section 1 of the 1993 Act. The Bill for the 2019 Act received Royal Assent on 30 July 2019. Sections 62, 63 and 64 came into force on the following day.
