The Registration of Births, Still-births, Deaths and Marriages (Prescription of Forms) (Scotland) Amendment Regulations 2024

In accordance with section 54(1) of the Registration of Births, Deaths and Marriages (Scotland) Act 1965[^f00002], the Scottish Ministers have approved the making of these Regulations.
Citation and commencement

These Regulations may be cited as the Registration of Births, Still-births, Deaths and Marriages (Prescription of Forms) (Scotland) Amendment Regulations 2024 and come into force on 1 November 2024.
Replacement of change of name registration forms

- (1) The Registration of Births, Still-births, Deaths and Marriages (Prescription of Forms) (Scotland) Regulations 1997[^f00003] are amended as follows.
- (2) For the form in schedule 18, substitute the form in schedule 1 of these Regulations.
- (3) For the form in schedule 19, substitute the form in schedule 2 of these Regulations.
- (4) For the form in schedule 20, substitute the form in schedule 3 to these Regulations.

Explanatory note
(This note is not part of the Regulations)
EXPLANATORY NOTE
These Regulations amend the Registration of Births, Still-births, Deaths and Marriages (Prescription of Forms) (Scotland) Regulations 1997.
They update the following forms prescribed in the schedules of those Regulations—
- the form in schedule 18 (Form 21- application for recording of forename(s) or change of forename(s) of child under 12 months of age),
- the form in schedule 19 (Form 23- application for recording of change of forename(s) or surname(s) of child under 16 years of age), and
- the form in schedule 20 (Form 24- application for recording of change of forename(s) or surname(s) of person over 16 years of age).
The Regulations apply from 1 November 2024.

Section 43(3) was amended by section 46(a) of the Local Electoral Administration and Registration Services (Scotland) Act 2006 (asp 14) (“the 2006 Act”) and schedule 5 of the Children (Scotland) Act 1995. Section 43(4) was amended by section 46(b) of the 2006 Act. Section 43(5) was amended by schedule 2 of the Age of Legal Capacity (Scotland) Act 1991 and section 46(b) of the 2006 Act. Sections 1 and 56(1) of the 1965 Act respectively contain definitions of “Registrar General” and “prescribed” relevant to the exercise of the powers under which these Regulations are made.
