The Rural Support (Simplification and Improvement) (Data Publication) (Scotland) Regulations 2025

The Scottish Ministers make the following Regulations in exercise of the powers conferred by section 2 of the Agriculture (Retained EU Law and Data) (Scotland) Act 2020[^f00001], and all other powers enabling them to do so.

Citation and commencement

These Regulations may be cited as the Rural Support (Simplification and Improvement) (Data Publication) (Scotland) Regulations 2025 and come into force on 1 January 2026.

Modification of Regulation (EU) No 1306/2013

• (1) Regulation (EU) No 1306/2013 of the European Parliament and of the Council of 17 December 2013 on the financing, management and monitoring of the common agricultural policy[^f00002] is amended in accordance with paragraph (2).

• (2) In Article 111(1) (Publication of beneficiaries) omit the final unnumbered subparagraph.

Modification of Commission Implementing Regulation (EU) No 908/2014

• (1) Commission Implementing Regulation (EU) No 908/2014 of 6 August 2014 laying down rules for the application of Regulation (EU) No 1306/2013 of the European Parliament and of the Council with regard to paying agencies and other bodies, financial management, clearance of accounts, rules on checks, securities and transparency[^f00003] is amended in accordance with paragraphs (2) to (4).

• (2) In Article 4(1) (Relevant authorities acting jointly) omit point (ii).

• (3) For Article 59 (Form and date of publication) substitute—

The information referred to in paragraph 1 of Article 111 of Regulation (EU) No 1306/2013 shall be published by 30 June each year for the preceding financial year and shall remain available for two years from the date of their initial publication.

• (4) Omit Article 62 (The Single Website).

Explanatory note

(This note is not part of the Regulations)

Explanatory Note

These Regulations simplify and improve the operation of CAP legislation by amending the requirements for publication of the CAP beneficiaries by no longer requiring this to be done on a single UK website.

Regulation 2 modifies Article 111 of Regulation (EU) No 1306/2013 by removing the requirement for the data to be made available for two years on a single website for the United Kingdom.

Regulation 3 is consequential upon the change made by regulation 2 and modifies Commission Implementing Regulation (EU) No 908/2014 by removing the references to the single UK website. Regulation 3 also confirms a new annual publication date.

A Data Protection Impact Assessment and a Business and Regulatory Impact Assessment have been prepared and placed in the Scottish Parliament Information Centre.
