The Local Governance (Scotland) Act 2004 (Remuneration) Amendment Regulations 2026

The Scottish Ministers make the following Regulations in exercise of the powers conferred by sections 11(1) and 16(2)(b) of the Local Governance (Scotland) Act 2004[^f00001] and all other powers enabling them to do so.
Citation and commencement

These Regulations may be cited as the Local Governance (Scotland) Act 2004 (Remuneration) Amendment Regulations 2026 and come into force on 1 April 2026.
Amendment of the Local Governance (Scotland) Act 2004 (Remuneration) Regulations 2007

- (1) The Local Governance (Scotland) Act 2004 (Remuneration) Regulations 2007[^f00002] are amended as follows.
- (2) For the table in regulation 6(2) (remuneration of the Leader of the Council) substitute—

- (5) In regulation 10 (Councillors’ remuneration) for “£25,982” substitute “£26,839”.
- (6) In regulation 12 (joint boards)—
- (a) in paragraph (8) (which concerns the total yearly amount to be paid to the convener of a joint board) for “£28,207” substitute “£29,138”,
- (b) in paragraph (9) (which concerns the total yearly amount to be paid to the vice-convener of a joint board) for “£26,797” substitute “£27,681”.

Explanatory note

Explanatory Note
These Regulations amend the Local Governance (Scotland) Act 2004 (Remuneration) Regulations 2007 (“the 2007 Regulations”). They substitute increased annual amounts for different categories of local authority remuneration to their members.
Regulation 2(2) makes provision for Council Leaders’ remuneration.
Regulation 2(3) provides new maximum levels for remuneration of Civic Heads. It is for each local authority to determine whether and to what extent such remuneration should be paid.
Regulation 2(4) sets the maximum amounts that may be paid to Senior Councillors in the different bandings. It is for each local authority to determine whether and to what extent such remuneration should be paid, though total remuneration of all Senior Councilors for a local authority cannot exceed the amount provided by the formula found at regulation 9(4) of the 2007 Regulations.
Regulation 2(5) sets new levels for Councillors’ remuneration.
Regulation 2(6) sets new levels of remuneration for councillors who perform the role of conveners or vice-conveners of joint boards.
