The National Bus Travel Concession Schemes (Miscellaneous Amendment) (Scotland) Order 2026
Made: 18th March 2026
Coming into force: 24th March 2026
The Scottish Ministers make the following Order in exercise of the powers conferred by section 40(1), (3) and (4) of the Transport (Scotland) Act 2005[^f00001] and all other powers enabling them to do so.
In accordance with section 52(3) of that Act, a draft of this instrument has been laid before and approved by resolution of the Scottish Parliament.
Citation and commencement

This Order may be cited as the National Bus Travel Concession Schemes (Miscellaneous Amendment) (Scotland) Order 2026 and comes into force on 24 March 2026.
Amendments to the National Bus Travel Concession Scheme for Older and Disabled Persons (Scotland) Order 2006

- (1) The National Bus Travel Concession Scheme for Older and Disabled Persons (Scotland) Order 2006[^f00002] is amended in accordance with paragraphs (2) to (4).
- (2) After article 14 insert—
(14A) (1) The Scottish Ministers may determine standards of conduct for eligible persons using the Scheme. (2) Any standards determined under paragraph (1) must be published in such manner as the Scottish Ministers consider appropriate.
- (3) In article 15(4) (travel cards)—
- (a) in sub-paragraph (a) for “; or” substitute “,”,
- (b) after sub-paragraph (a) insert—
(aa) if an eligible person has breached standards of conduct determined under article 14A while using the Scheme, or
- (4) After article 15(4) insert—
(5) Before making a decision under paragraph (4), the Scottish Ministers must— (a) give notice to the eligible person, (b) specify the grounds for withdrawal or suspension, and (c) provide the eligible person with an opportunity to make representations.

- (1) The National Bus Travel Concession Scheme for Young Persons (Scotland) Order 2021[^f00003] is amended in accordance with paragraphs (2) to (4).
- (2) After article 14 insert—
(14A) (1) The Scottish Ministers may determine standards of conduct for eligible persons using the scheme. (2) Any standards determined under paragraph (1) must be published in such manner as the Scottish Ministers consider appropriate.
- (3) In article 15(3) (travel cards)—
- (a) in sub-paragraph (a) omit “or”,
- (b) after sub-paragraph (a) insert—
(aa) if an eligible person breached standards of conduct determined under article 14A while using the scheme, or
- (4) After article 15(3) insert—
(4) Before making a decision under paragraph (3), the Scottish Ministers must— (a) give notice to the eligible person, (b) specify the grounds for withdrawal or suspension, and (c) provide the eligible person with an opportunity to make representations.

Explanatory Note
This Order amends the National Bus Travel Concession Scheme for Older and Disabled Persons (Scotland) Order 2006 (“the 2006 Order”) and the National Bus Travel Concession Scheme for Young Persons (Scotland) Order 2021 (the “2021 Order”). Article 2 inserts a new article 14A and amends article 15 the 2006 Order to give Ministers the power to withdraw or suspend concessionary travel where an individual is found to be in breach of standards of conduct determined by the Scottish Ministers while using the scheme. Additionally, article 2 sets out procedural requirements to be followed before withdrawing or suspending concessionary travel. Article 3 amends the 2021 Order in the same way.
