The Secretary of State for Social Services, in exercise of his powers under section 4(6) and (7) of the National Insurance Act 1965, and the National Insurance Joint Authority, in conjunction with the Treasury, in exercise of the powers conferred by section 99 of that Act (as extended by section 1(1) of and Schedule 1 paragraph 9 to the National Insurance Act 1966, in each case in exercise of all other powers enabling him or them in that behalf, hereby make the following regulations which contain no provisions other than such as are made in consequence of the National Insurance Act 1969 and which, accordingly, by virtue of the provisions of section 10(1)(a)(i) of the said Act of 1969, are exempt from the requirements of section 108 of the said Act of 1965 (preliminary draft of regulations to be submitted to the National Insurance Advisory Committee before the regulations are made):—
Citation, interpretation and commencement

These regulations, which may be cited as the National Insurance (Members of the Forces) Amendment Regulations 1969, shall be read as one with the National Insurance (Members of the Forces) Regulations 1968[^f00001] (hereinafter referred to as “the principal regulations”) and shall come into operation on the 3rd November 1969.
Amendment of regulation 5 of the principal regulations

In regulation 5 of the principal regulations (special provisions concerning graduated contributions), for paragraphs (3) and (4) there shall be substituted the following paragraph:—
(3) As respects an employed person (being a serving member of the forces), the statutory provisions specified in column (1) of Schedule 4 to these regulations shall apply in relation to his employment as a serving member of the forces subject to the modifications shown in relation thereto in column (3) of that Schedule, so however that the said modifications shall be disregarded for the purposes of section 58 of the Act (payments in lieu of contributions).
Substitution of new Schedules for Schedules 3, 4 and 5 to the principal regulations and insertion of additional Schedule

For the provisions set out in Schedules 3 (reduction of weekly rates of flat-rate contributions), 4 (statutory provisions applying to graduated contributions which are modified in their application to employment as a serving member of the forces) and 5 (scale of graduated contributions) to the principal regulations, there shall respectively be substituted the provisions set out in Schedules 1, 2 and 3 to these regulations; and immediately after the said Schedule 5 as so substituted, there shall be inserted as Schedule 5A the Schedule set out in Schedule 4 to these regulations.

Explanatory note
EXPLANATORY NOTE
These Regulations contain no provisions other than such as are made in consequence of the National Insurance Act 1969 and accordingly, by virtue of section 10(1) of that Act, they are exempt from reference to the National Insurance Advisory Committee and have not been referred to that Committee.
The Regulations amend the provisions of the National Insurance (Members of the Forces) Regulations 1968 relating to flat-rate and graduated contributions and for the first time graduated contributions in respect of non-participating employment as a serving member of the forces become payable. The rate of such contributions, however, as with the rate of graduated contributions in respect of employment as a serving member of the forces which is not non-participating employment and the rate of flat-rate contributions as a serving member of the forces, is a reduced rate.
