The Industrial Training (Gas Industry Board) (Revocation) Order 1973

Coming into Operation

The Secretary of State after consultation with the Gas Industry Training Board, with the British Gas Corporation, being the sole employer engaged in the activities of the gas industry, and with organisations and associations of organisations appearing to be representative of substantial numbers of persons employed in the activities of the gas industry and in the exercise of his powers under section 9 of the Industrial Training Act 1964 and of all other powers enabling him in that behalf hereby makes the following order:—

Citation, commencement and interpretation

• (1) This Order may be cited as the Industrial Training (Gas Industry Board) (Revocation) Order 1973.

• (2) Article 3 of this Order shall come into operation on 1st April 1974.

• (3) The provisions of this Order, other than Article 3, shall come into operation on 1st January 1974.

• (4) In this Order—

• (a) “the Act” means the Industrial Training Act 1964 and references in this Order to sections are references to sections in the Act;

• (b) “the Board” means the Gas Industry Training Board;

• (c) “the Corporation” means the body established under the Gas Act 1948 by the name of the Gas Council and named the British Gas Corporation by section 1 of the Gas Act 1972;

• (d) “the former employers in the gas industry” means the Area Gas Boards, whose property, rights, liabilities and obligations were vested in the Corporation on 1st January 1973 by section 1(1) of the Gas Act 1972;

• (e) “the gas industry” means the industry described in the Industrial Training Order;

• (f) “the Industrial Training Order” means the Industrial Training (Gas Industry Board) Order 1965[^f00001].

• (g) “the remaining assets” meansany amount by which the assets of the Board immediately before 1st April 1974 may exceed the amount which has been required to meet the liabilities of the Board and the expenses of the winding up.

• (5) The Interpretation Act 1889 shall apply to the interpretation of this Order as it applies to the interpretation of an Act of Parliament and as if this Order and the Industrial Training Order were Acts of Parliament.

Winding up of the Board

• (1) The Board shall be wound up in accordance with the provisions of this Article.

• (2) On the coming into operation of this Article the Board shall cease to exercise its functions except insofar as continued exercise of those functions may be necessary or expedient for the purpose of the winding up.

• (3) Between the coming into operation of this Article and 1st April 1974 the Board shall discharge its liabilities.

• (4) Immediately before 1st April 1974 the Board shall transfer to, or to the order of, the Secretary of State in such manner as he may direct the remaining assets of the Board and those assets shall be applied by the Secretary of State for the purpose specified in paragraph (5) of this Article.

• (5) The specified purpose shall be the repayment (as the case may allow in whole or in part) to the Corporation of levies paid by the Corporation and by the former employers in the gas industry.

• (6) The accounts of the Board up to 1st April 1974 shall be prepared and audited in accordance with section 8 and those accounts and the final report of the Board shall be laid before Parliament in accordance with that section.

Revocation of Industrial Training Order

The Industrial Training Order is hereby revoked.

Explanatory note

EXPLANATORY NOTE

This Order provides with effect from 1st January 1974 for the winding up of the Gas Industry Training Board, which was established by the Industrial Training (Gas Industry Board) Order 1965, and for the revocation of that Order with effect from 1st April 1974. Any assets remaining on the completion of the winding up are to be applied for the purpose of repaying levy to the British Gas Corporation, now the sole employer in the industry, which was formerly called the Gas Council and is the successor body to the Area Boards who until 1st January 1973 were, together with the Gas Council, the employers in the industry.
