Made: 19th June 1975

Coming into Operation: 28th July 1975

The Secretary of State in exercise of the powers conferred on him by section 15(1) and (3)(a) of the Health and Safety at Work etc. Act 1974 and of all other powers enabling him in that behalf and for the purpose of giving effect without modifications to proposals submitted to him by the Health and Safety Commission under section 11(2)(d) of the said Act after the carrying out by the said Commission of consultations in accordance with section 50(3) of the said Act, hereby makes the following Regulations:—

In the Factories Act 1961, the provisions mentioned in column 1 of the Schedule to these Regulations are hereby repealed to the extent specified in column 2 of that Schedule.

SCHEDULE — REPEALS—THE FACTORIES ACT 1961

Provision Extent of repeal
Section 125. In subsection (2), paragraph (h) and the words in paragraph (j) from “and the provisions” to the end of the paragraph; and in subsection (3), the reference to paragraph (h) of subsection (2).
Section 126. In subsection (2), paragraph (h) and the words in paragraph (j) “and duties of persons employed”.
Section 127. In subsection (2), paragraph (h) and the words in paragraph (j) “and duties of persons employed”.
Section 136. The whole section.
Section 143. The whole section.
Section 155. In subsection (2), the words from “of a contravention by an employed person” to “persons employed or” and the words “the contravention of the said provisions of Part X of this Act, or”.

Explanatory note

EXPLANATORY NOTE

These Regulations repeal the following provisions of the Factories Act 1961, namely, section 136 (prohibition of deductions from wages in respect of things done or provided pursuant to the Act) and section 143 (duties of persons employed), which have been superseded by provisions of the Health and Safety at Work etc. Act 1974 and make consequential repeals in certain other provisions of the 1961 Act.
