The Medicines (Termination of Transitional Exemptions) (No. 3) Order 1975

Made: 7th May 1975

The Secretaries of State respectively concerned with health in England and in Wales, the Secretary of State concerned with health and with agriculture in Scotland, the Minister of Agriculture, Fisheries and Food, the Department of Health and Social Services for Northern Ireland and the Department of Agriculture for Northern Ireland, acting jointly, in exercise of powers conferred by section 17 of the Medicines Act 1968 and now vested in them[^f00001] and of all other powers enabling them in that behalf, after consulting such organisations as appear to them to be representative of interests likely to be substantially affected by the following Order, hereby make the following Order:—

Citation and interpretation

• (1) This Order may be cited as the Medicines (Termination of Transitional Exemptions) (No. 3) Order 1975.

• (2) In this Order, unless the context otherwise requires, “the Act” means the Medicines Act 1968 and other expressions have the same meanings as in the Act.

• (3) The rules for the construction of Acts of Parliament contained in the Interpretation Act 1889 shall apply for the purposes of the interpretation of this Order as they apply for the purposes of the interpretation of an Act of Parliament.

Termination of transitional exemptions from licences for wholesale dealing in certain medicinal products for human use

The 1st June 1975 shall be the day appointed for the purposes of subsections (2) to (5) of section 16 of the Act (transitional exemptions) as being the day upon which those subsections shall cease to have effect in relation to anything done on or after that day in so far as it consists of the sale or offer for sale by way of wholesale dealing of a medicinal product, other than a veterinary drug, which may be lawfully sold by retail otherwise than in accordance with a prescription given by a doctor or dentist, or from premises other than a registered pharmacy.

Explanatory note

EXPLANATORY NOTE

The Medicines (Termination of Transitional Exemptions) (No. 1) Order 1972 (S.I. 1972/1198) appointed 1st September 1972 as the day upon which the transitional exemptions from the licensing requirements of the Medicines Act 1968 (section 16) ceased to have effect in relation to anything done on or after that day, except in relation to ingredients that are medicinal products (section 130(1)(b) and (3) of that Act) and wholesale dealing in certain medicinal products for human use only. The Medicines (Termination of Transitional Exemptions) (No. 2) Order 1974 (S.I. 1974/1149) appointed 1st September 1974 as the day for the ending of the transitional exemptions in relation to such ingredients and this Order appoints 1st June 1975 as the day for finally ending the remaining transitional exemptions in relation to such wholesale dealing.
