The Pensions Increase (Northern Ireland Reserved Services) Regulations 1976

The Minister for the Civil Service, in exercise of the powers conferred on him by section 5(2) and (4) of the Pensions (Increase) Act 1971 and of all other powers enabling him in that behalf, hereby makes the following Regulations:—

These Regulations may be cited as the Pensions Increase (Northern Ireland Reserved Services) Regulations 1976, and shall come into operation on 4th March 1976.

• (1) Any reference in these Regulations to any enactment is a reference to that enactment as amended by or under, and includes a reference to that enactment as extended or applied by, any other enactment; and in this paragraph “enactment” includes an enactment of the Parliament of Northern Ireland.

• (2) The Interpretation Act 1889 shall apply for the interpretation of these Regulations as it applies for the interpretation of an Act of Parliament.

The Pensions (Increase) Act 1971 shall have effect in relation to the pensions specified in the Schedule to these Regulations as if they were specified in Part I of Schedule 2 to that Act.

Any increase of pension payable by virtue of these Regulations shall take effect from 1st October 1975.

SCHEDULE — PENSIONS TO WHICH THE PENSIONS (INCREASE) ACT 1971 IS TO APPLY

A pension payable out of moneys provided by Parliament by virtue of section 12 of the Administration of Justice Act (Northern Ireland) 1954 (caretakers of court-houses).

A pension payable by way of compensation to Civil Defence employees under Regulations made under section 4 of the Public Expenditure and Receipts Act (Northern Ireland) 1968.

A pension payable by virtue of section 6 of the Summary Jurisdiction and Criminal Justice Act (Northern Ireland) 1935 (resident magistrates).

Explanatory note

EXPLANATORY NOTE

These Regulations apply the Pensions (Increase) Act 1971 to the pensions payable in respect of service in certain offices and occupations in Northern Ireland which are now reserved services by virtue of the Northern Ireland Constitution Act 1973, and the pensions are payable out of the Consolidated Fund of the United Kingdom or out of moneys provided by the Parliament of the United Kingdom.
