Coming into Operation: 1st January 1977

The Secretary of State in exercise of the powers conferred on him by sections 15(1) and (3)(a) and 82(3)(a) of the Health and Safety at Work, etc. Act 1974(“the 1974 Act”) as amended by section 116 of and paragraph 6 of Schedule 15 to the Employment Protection Act 1975 and of all other powers enabling him in that behalf and for the purpose of giving effect without modifications to proposals submitted to him by the Health and Safety Commission under section 11(2)(d) of the 1974 Act after the carrying out by the said Commission of consultations in accordance with section 50(3) of that Act, hereby makes the following Regulations:—

Repeals—the Offices, Shops and Railway Premises Act 1963

In the Offices, Shops and Railway Premises Act 1963 the provisions mentioned in column 1 of the Schedule to these Regulations are hereby repealed to the extent specified in column 2 of that Schedule.

Revocations—instruments under the Offices, Shops and Railway Premises Act 1963

are hereby revoked.

Supplemental

These Regulations shall not affect the validity of anything done under any provision repealed by the Regulations before the coming into operation of the Regulations.

SCHEDULE — REPEALS OF PROVISIONS OF THE OFFICES, SHOPS AND RAILWAY PREMISES ACT 1963

Section 42. Subsections (11) and (12). Subsection (13) except in relation to offences committed before 1st January 1977. Subsections (14) to (16) .
Section 43. Subsections (9) and (10). Subsection (11) except in relation to offences committed before 1st January 1977. Subsections (12) to (14) .
Section 52. In subsection (1), paragraph (a) and in paragraph (b) the words “as regards any other section or regulations” and “for the enforcement of that section or those regulations”. Subsection (2). In subsection (4) the words “(except sections 28, 29 and 30 and regulations under section 35)”. In subsection (5) the words from “other than provisions” to the end of the subsection. In subsection (6) the words “(except sections 28, 29 and 30 and regulations under section 35)”.
Section 53. The whole section, so far as still in operation.
Section 55. The whole section, so far as aforesaid.
Section 60. Subsection (1). Subsection (2) except in relation to reports made before 1st January 1977.
Section 63. In subsection (2) the words “28, 29(6), 30(1), 33 to 38” except in relation to offences committed before 1st January 1977.
Section 64. The whole section except in relation to offences under sections 28 to 38, 42(16) and 43(14) committed before 1st January 1977.
Section 70. Subsection (1) so far as still in operation.
Section 71. Subsection (2).
Section 73. In subsection (1) the words from “in order to comply with a requirement” to “the said section 30(4)”.
Section 76. Subsections (1) and (2).
Section 83. In subsection (1) the words “28, 29(1) and (11), 33, 34, 35(1), 36 to 38” . Subsection (3) . In subsection (5) the words “and 53”.
Section 90. The definition of “fire certificate”.

Explanatory note

EXPLANATORY NOTE

These Regulations contain repeals of provisions of the Offices, Shops and Railway Premises Act 1963 and instruments thereunder relating to fire precautions.

They are made in consequence of the coming into operation on 1st January 1977 of—

which together supersede the provisions repealed by these Regulations.
