Made: 13th May 1977

In exercise of the powers conferred on me by section 79(2) and (7) of the Race Relations Act 1976, I hereby make, the following Order:—

This Order may be cited as the Race Relations Act 1976 (Commencement No. 2) Order 1977.

In this Order “the Act” means the Race Relations Act 1976.

Subject to the transitional provision of Article 4 below, the Act, except so far as it is already in operation, shall come into operation on 13th June 1977.

Until 1st September 1977, sections 1(1) and 3(3) of the Act (definition of discrimination) shall have effect for the purposes of sections 17, 18 and 19 of the Act (discrimination in the field of education) as if paragraph (b) were omitted from the said section 1(1).

Explanatory note

EXPLANATORY NOTE

The Race Relations Act 1976 (Commencement No. 1) Order 1977 (S.I. 1977/680 (C. 26)) brought into operation on 28th April 1977 certain provisions of the 1976 Act contained in Part X (Supplemental) and, so far only as was necessary for the purpose of establishing the Commission for Racial Equality and enabling it to make arrangements for the exercise of its functions, section 43 and Schedule 1.

Subject to the transitional provision of Article 4, this Order brings the 1976 Act (including section 43 and Schedule 1) into operation on 13th June 1977 except so far as it is already in operation by virtue of the earlier Order. Article 4 of the Order postpones the operation of section 1(1)(b) of the Act in the field of education until 1st September 1977.
