Present,

The Queen's Most Excellent Majesty in Council

Her Majesty, in exercise of the powers conferred upon Her by section 10(3) of the Evidence (Proceedings in Other Jurisdictions) Act 1975, or otherwise in Her Majesty vested, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:—

This Order may be cited as the Evidence (Proceedings in Other Jurisdictions) (Gibraltar) Order 1978 and shall come into operation on 10th January 1979.

The Interpretation Act 1889 shall apply, with the necessary adaptations, for the purpose of interpreting this Order and otherwise in relation thereto as it applies for the purpose of interpreting, and in relation to, Acts of Parliament.

Subsections (2), (3) and (4) of section 8 of the Evidence (Proceedings in Other Jurisdictions) Act 1975 and the provisions of Schedule 2 to that Act that relate to the Foreign Tribunals Evidence Act 1856, the Evidence by Commission Act 1859, the Extradition Act 1870, the Evidence by Commission Act 1885 and section 3(1)(b) of the Arbitration (International Investment Disputes) Act 1966, as amended in its application to Gibraltar[^f00001], shall extend to Gibraltar.

Explanatory note

EXPLANATORY NOTE

This Order extends to Gibraltar the provisions of the Evidence (Proceedings in Other Jurisdictions) Act 1975 that provide for the repeal of the Foreign Tribunals Evidence Act 1856, the Evidence by Commission Act 1859, section 24 of the Extradition Act 1870, the Evidence by Commission Act 1885 and section 3(1)(b) of the Arbitration (International Investment Disputes) Act 1966.
